Automail Digital is committed to maintaining a safe, secure, and compliant platform across both our email marketing service and the Automail Biz B2B Business Directory. This Acceptable Use Policy ("AUP") outlines the conduct we expect from all users. Violation of this policy may result in account suspension or termination.
2. Prohibited Activities
2.1 Illegal Content
You may not use the Service to:
- Send content that is illegal in the jurisdictions where recipients are located
- Distribute malware, viruses, or other harmful code
- Facilitate fraud, phishing, or identity theft
- Engage in money laundering or terrorist financing
- Violate intellectual property, trademark, or copyright laws
2.2 Spam and Unsolicited Communications
We maintain strict anti-spam standards:
- All emails must comply with CAN-SPAM (US), GDPR (EU), CASL (Canada), and other applicable laws
- Recipients must have explicitly opted in to receive communications
- You must provide a clear unsubscribe mechanism in all emails
- Sending unsolicited bulk emails is strictly prohibited
- List farming, harvesting, or purchasing low-quality lists is not permitted
- You must maintain accurate sender information and contact details
2.3 Harassment and Abusive Content
You may not use the Service to:
- Send threatening, harassing, or abusive messages
- Engage in cyberstalking or targeted harassment
- Discriminate against individuals based on protected characteristics
- Send content designed to cause psychological harm
2.4 Deceptive Practices
- False or misleading subject lines
- Disguised sender identity or email spoofing
- Deceptive header information or routing
- False claims about product efficacy or endorsements
- Conducting unauthorized testing on users
2.5 Prohibited Content
Email content must not include:
- Sexually explicit material or child exploitation content
- Graphic violence or gore
- Hate speech targeting protected groups
- Incitement to violence or illegal activities
- Content promoting self-harm or eating disorders
- Illegal drug paraphernalia or promotion
3. Compliance Requirements
3.1 Email List Management
- Maintain list hygiene by removing inactive subscribers regularly
- Keep accurate records of opt-in dates and methods
- Respect user preferences and segment lists appropriately
- Provide a working unsubscribe link in every email
- Honor unsubscribe requests within 10 business days
3.2 Authentication
- Implement SPF, DKIM, and DMARC authentication
- Use authenticated sending domains
- Maintain forwarding and authentication records
3.3 Sending Practices
- Avoid suspicious sending patterns indicative of spam
- Do not send emails from recently created accounts without verification
- Maintain consistent sending protocols
- Throttle send rates to avoid network issues
- Monitor bounce rates and remove invalid addresses
4. Prohibited Industries and Activities
While we support diverse industries, the following uses are prohibited across both the email marketing platform and Automail Biz directory:
4.1 Universally Prohibited
- Unlicensed pharmaceutical or medical services
- Unregulated financial services or investment scams
- Counterfeit, replica, or stolen products
- Pyramid schemes or multi-level marketing (MLM) with emphasis on recruitment
- Adult or sexually explicit services without appropriate restrictions
- Unlicensed gambling or betting services
4.2 Prohibited on Automail Biz (B2B Directory)
The following products, services, and business categories are prohibited from listing on Automail Biz. This list is compiled with reference to applicable Indian statutes and international conventions, and is not derived from or based on the policies of any third-party platform:
- Weapons & Explosives: Firearms, ammunition, cluster munitions, anti-personnel mines, explosives, and military-grade equipment (unless holding valid Indian Government defense manufacturing license)
- Controlled Substances: Illegal drugs, narcotics, psychotropic substances, and drug paraphernalia as defined under the NDPS Act 1985
- Unregulated Pharmaceuticals: Prescription medicines listed under Schedule H/H1 of the Drugs and Cosmetics Rules 1945 without valid Drug License; unapproved medical devices
- Tobacco & Vaping Products: Cigarettes, bidis, e-cigarettes, vaping devices, and smokeless tobacco products (advertising restricted under COTPA 2003 and the Prohibition of Electronic Cigarettes Act 2019)
- Wildlife & Environment: Products derived from endangered species (per CITES and Wildlife Protection Act 1972), ivory, illegal timber, and banned pesticides or chemicals
- Counterfeit & Infringing Goods: Products bearing unauthorized trademarks, fake certifications (ISO, BIS, FSSAI), and goods misrepresenting origin or quality
- Financial Fraud: Ponzi schemes, chit funds operating without RBI/state registration, unregulated forex or crypto exchanges, and loan sharking operations
- Hazardous Materials: Asbestos products, banned chemicals, radioactive materials, and substances prohibited under the Environment Protection Act 1986 (without valid license)
- Human Exploitation: Services facilitating human trafficking, forced labor, bonded labor, or child labor
- Deceptive Products: \"Magic remedies\" as defined under the Drugs and Magic Remedies (Objectionable Advertisements) Act 1954, fake health cures, and products with fraudulent claims
- Sanctioned Entities: Businesses or individuals under UN, OFAC, EU, or Indian Government sanctions lists
- Stolen Property & Piracy: Stolen goods, pirated software, pirated media, and intellectual property theft
- Surveillance & Hacking: Spy equipment, phone tapping devices, unauthorized surveillance tools, and hacking tools
- Organ & Human Body Parts: Buying, selling, or trading of human organs or body parts
5. Automail Biz \u2014 Directory-Specific Rules
5.1 Listing Accuracy & Integrity
- All business information must be truthful, accurate, and up-to-date
- Business names must reflect the actual registered or trading name of the entity
- Product images must accurately represent the actual products offered
- Pricing, MOQ, and specification details must not be intentionally misleading
- GST, MSME, PAN, and other regulatory numbers (if provided) must be valid and belong to the listing business
- Certifications and awards claimed must be genuine and verifiable
5.2 Inquiry System Rules
For Buyers:
- Inquiries must represent genuine business interest
- Submitting fake, spam, or automated inquiries is prohibited
- Using the inquiry system to harvest seller contact information without purchase intent is not permitted
- Abusive, threatening, or inappropriate messages in inquiries will result in blocking
For Sellers:
- Buyer inquiry data must be used only to respond to the specific business inquiry
- Adding buyers to marketing email lists without their explicit consent is prohibited
- Sharing or reselling buyer inquiry data to third parties is strictly prohibited
- Inquiry sequences must include an unsubscribe mechanism and must not exceed reasonable follow-up frequency
5.3 Duplicate & Spam Listings
- Creating multiple business pages for the same entity to gain unfair visibility is prohibited
- Keyword stuffing in business descriptions, product names, or tags to manipulate search results is not allowed
- Listing products or services unrelated to your actual business category is prohibited
5.4 Reporting Violations on Automail Biz
If you encounter a listing that violates this policy, you can report it using the report function on the business page or by emailing support@automail.digital with the listing URL and details of the violation. We will investigate and take appropriate action within 48 hours.
6. Monitoring and Enforcement
Automail Digital monitors accounts for compliance with this policy. We may:
- Review email templates and campaign data for violations
- Monitor sending patterns and complaint rates
- Investigate reports from recipients or ISPs
- Implement temporary or permanent restrictions on accounts
- Cooperate with law enforcement when required
- Review Automail Biz listings for prohibited products, fraudulent claims, and policy violations
- Monitor inquiry patterns for spam, abuse, or data harvesting activity
7. Consequences of Violations
Minor violations may result in warnings or temporary account restrictions. Serious or repeated violations may result in:
- Account suspension or permanent termination
- Forfeiture of account balance or credits
- IP blacklisting or sender reputation damage
- Legal action if applicable laws are violated
8. Reporting Abuse
If you believe another user is violating this policy, please report it to support@automail.digital with details of the violation. We will investigate and take appropriate action.
9. Third-Party Services
Users are responsible for ensuring third-party integrations, add-ons, and services comply with this policy. Automail is not liable for violations by third parties.
10. Modifications to This Policy
Automail Digital reserves the right to update this Acceptable Use Policy at any time. Continued use of the Service after updates constitutes acceptance of the revised policy.
