Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Automail Digital ("Automail", "we", "us", "our") governing your access to and use of any service operated by Automail Digital, including the Automail email marketing and automation platform available at app.automail.digital and the Automail Biz B2B Business Directory available at biz.automail.digital. By registering, accessing, or using any part of these services, you accept and agree to be bound by all terms and provisions of this agreement. If you do not agree, you must not use our services.
2. Account Registration
To access the Automail email marketing platform, you must create an account. The following conditions apply to all accounts:
- You must register using a valid email address or a supported identity provider as offered on the sign-in screen.
- You must be at least 18 years of age to create an account and use the Service commercially.
- One person or legal entity may not maintain more than one free account at a time.
- You must provide accurate, current, and complete information at registration and keep it up to date.
- You are solely responsible for maintaining the confidentiality of your account credentials, passwords, and any email sending or receiving credentials you configure within the platform.
- You agree to accept full responsibility for all activity that occurs under your account, whether or not you authorised it.
- You must notify us immediately at support@automail.digital of any suspected unauthorised use of your account.
- Automail reserves the right to reject, suspend, or terminate any account whose registration data, usage patterns, or associated activity appear incomplete, fraudulent, automated, or inconsistent with these Terms.
3. Description of the Automail Email Marketing Platform
The Automail email marketing platform is a cloud-hosted service that enables users to design, schedule, and automate outbound email communications. The platform provides:
- Subscriber Management: Import and organise subscriber lists from connected spreadsheet sources or through manual entry.
- Email Sequences: Create automated, multi-step email journeys with configurable sending delays, conditions, and triggers.
- Smart Sequences: Advanced automation with reply detection, conditional branching, and recipient-behaviour triggers.
- Template Library: Create, save, and reuse email templates with dynamic merge-field substitution.
- Sequence Analytics: Track delivery, open, click, bounce, and reply metrics for each sequence and campaign.
- Spreadsheet Integration: Connect cloud spreadsheet sources as subscriber data inputs with two-way data synchronisation for delivery status write-back.
- Custom Sending Configuration: Connect your own outbound email servers and sending accounts for campaign delivery.
- Multi-Account Sending Distribution: Distribute campaign volume across multiple configured sending accounts to improve deliverability and manage sending limits.
New features, beta functionality, and regional workflows added to the platform from time to time are governed by these Terms unless Automail Digital publishes separate supplemental terms for a specific feature.
4. Connected Account Authorisations
Certain features of the Automail email marketing platform require you to authorise access to third-party accounts or services you own. The following governs such authorisations:
- Identity Authentication: Where sign-in via a supported identity provider is offered, Automail accesses only the information necessary to create and maintain your account — typically your email address, display name, and profile image.
- Spreadsheet Source Access: When you connect a cloud spreadsheet as a subscriber source, Automail reads the column headers and subscriber rows you designate, and may write delivery status updates back to that spreadsheet. Access is scoped to files you explicitly open or connect through the platform.
- Cloud File Browsing: Where a file-picker interface is provided, Automail accesses only files and folders you navigate to or explicitly select within that picker session. We do not access files you have not opened through the platform.
- Custom Sending Account Credentials: If you configure outbound sending server credentials, those credentials are encrypted at rest using AES-256 encryption and are used exclusively to deliver email on your behalf as directed by your sequence settings.
- Scope of Use: Data accessed through any connected account authorisation is used solely to deliver the specific platform feature for which you granted access. It is never used for advertising, profiling, or sold to any third party.
- Revocation: You may disconnect any connected account authorisation at any time through your account settings. Disconnecting a source will halt dependent sequences and synchronisations. You may also revoke access through the third-party provider's own account management interface.
- Compliance: Automail's use of data obtained through connected account authorisations complies with applicable data processing standards and the usage policies of the respective services. We do not use such data beyond the scope of what is necessary to operate the features you have activated.
5. Acceptable Use — Email Marketing Platform
You agree to use the Automail email marketing platform only for lawful purposes and in accordance with these Terms. You must not:
- Send unsolicited bulk email, spam, or any communication to recipients who have not provided verifiable opt-in consent.
- Import or use subscriber lists that were purchased, rented, scraped, harvested, or obtained from third-party data brokers.
- Send emails containing malware, phishing content, deceptive links, misleading sender information, or fraudulent subject lines.
- Violate any applicable anti-spam law, data protection regulation, or electronic communications regulation, including those of the jurisdiction in which your recipients are located.
- Impersonate another person, organisation, or brand in any email, sender name, or reply-to address.
- Use the platform to harass, threaten, defame, or abuse any individual or organisation.
- Attempt to access, probe, or exploit any other user's account, data, sequences, or configurations.
- Reverse-engineer, decompile, disassemble, scrape, or systematically extract the platform's software, logic, infrastructure, pricing data, or user data.
- Circumvent rate limits, usage quotas, sending limits, or access controls through automated means or technical workarounds.
- Use data obtained through connected account integrations for any purpose beyond the email marketing features expressly provided by the platform.
- Configure sending credentials belonging to another person or organisation without their explicit, documented authorisation.
6. Email Sending Standards and Compliance
When using Automail to send email communications, you are solely responsible for meeting all legal and technical standards applicable to your campaigns. The following requirements apply to all accounts:
- Every campaign or sequence email must include a clearly visible, functional unsubscribe mechanism.
- You must honour all unsubscribe and opt-out requests without delay and must not re-add unsubscribed contacts to active sequences.
- You are solely responsible for the content of all emails sent through the platform, including accuracy of claims, appropriate consents obtained from recipients, and compliance with applicable consumer protection and advertising standards.
- Your configured sending account, domain reputation, SPF records, DKIM signatures, and DMARC policy are your responsibility. Automail acts as an email client routing your outbound mail through servers you configure and does not itself operate outbound mail infrastructure on your behalf.
- Campaigns generating hard bounce rates above 5% or spam complaint rates above 0.1% may trigger an account review, sending restriction, or suspension at Automail's discretion.
- You must comply with all applicable legislation governing electronic commercial communications in the jurisdictions in which you and your recipients operate.
7. Subscription Plans and Billing
Access to certain platform features is subject to a paid subscription. The following terms apply to all billing:
- Free plans are subject to usage limits as described on our pricing page and may be modified with reasonable notice.
- Paid plans are billed on a monthly or annual basis as selected at the time of purchase. All prices are denominated in Indian Rupees (₹) and are exclusive of applicable taxes.
- Plan upgrades take effect immediately upon confirmation. Plan downgrades take effect at the start of the next billing cycle.
- Automail reserves the right to adjust subscription pricing with a minimum of 30 days' advance notice to affected users.
- Failure to complete a payment when due may result in temporary restriction of account features or suspension of the account until payment is resolved.
- Refunds are handled on a case-by-case basis at Automail's discretion. Contact support@automail.digital with refund requests. Refunds are not provided for partial billing periods unless required by applicable law.
- All invoices and billing records are available within your account settings.
8. Data Ownership and User Content
You retain full ownership of all subscriber data, email content, sequence configurations, and templates you create or upload to the platform. The following additional terms apply:
- By using the platform, you grant Automail a limited, non-exclusive, royalty-free licence to store, process, and transmit your content solely to the extent necessary to provide the Service.
- Automail does not sell, rent, or disclose your subscriber data, email content, or account data to any third party for commercial, marketing, or advertising purposes.
- Data accessed through connected account integrations is processed only for the specific platform feature you activated and is not retained beyond what is operationally required to deliver that feature.
- You may export your subscriber lists, sequence data, and templates at any time through your account settings.
- Upon account deletion, your personal data and associated content will be purged within 30 days, subject to data we are required to retain for legal, accounting, or regulatory compliance purposes.
- Automail retains the right to maintain anonymised, aggregated platform analytics derived from usage patterns. Such data does not identify individual users or contain subscriber-level information.
9. Service Availability and Platform Warranties
Automail strives to maintain high service availability but operates on an "as is" and "as available" basis. No warranty of uninterrupted, error-free, or fully secure operation is provided or implied. In particular:
- Scheduled maintenance may occasionally be required. Where commercially reasonable, advance notice will be provided via in-app notification or email.
- Automail is not liable for interruptions, delays, or failures caused by third-party infrastructure, cloud hosting providers, email delivery networks, internet service providers, or external services beyond our direct control.
- Email deliverability depends on factors including but not limited to your sending domain's reputation, recipient mailbox provider policies, network conditions, and the quality of your subscriber data. Automail does not guarantee delivery of any specific email.
- Automail disclaims all warranties, expressed or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of materials.
- In no event shall Automail, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, reputational harm, or business interruption, arising from your use or inability to use the platform, even if advised of the possibility of such damages.
- Automail's total aggregate liability to you for direct damages arising from the platform shall not exceed the amount you paid to Automail in the three-month period immediately preceding the event giving rise to the claim.
10. Prohibited Conduct — General
In addition to the platform-specific restrictions above, the following conduct is prohibited across all Automail services:
- Engaging in phishing, hacking, credential theft, or any other malicious or deceptive technical activity
- Harassing, threatening, defaming, or abusing any person through any Automail service or communication channel
- Violating any applicable local, state, national, or international law or regulation
- Attempting to gain unauthorised access to Automail's systems, servers, databases, or other users' accounts
- Renting, leasing, selling, sublicensing, or otherwise transferring your account or account access to any third party
- Using any Automail service to facilitate money laundering, fraud, identity theft, or sanctioned trade
10.1 Prohibited Conduct on Automail Biz
In addition to the general prohibitions above, Automail Biz users must not publish, promote, inquire about, broker, or facilitate any listing, product, service, requirement, message, or transaction that is unlawful, restricted without a valid license, unsafe, fraudulent, counterfeit, infringing, deceptive, sanctioned, or otherwise prohibited under applicable law or Automail's policies. You also agree not to:
- Publish false, misleading, incomplete, or fraudulent business information on a listing, RFQ, inquiry, review, chat, call request, or buyer profile
- List products or services you are not legally authorized, licensed, registered, or permitted to sell or provide
- Impersonate another business or falsely claim affiliations, certifications, registration numbers, verification status, endorsements, awards, or procurement approvals
- Scrape, harvest, reverse engineer, bulk download, resell, or systematically extract directory data, business listings, buyer contact information, seller contact information, pricing intelligence, RFQs, or inquiry records
- Submit fake inquiries, fake RFQs, fake reviews, fake reports, synthetic buyer activity, or otherwise manipulate view, inquiry, quote, shortlist, verification, ranking, alert, or response metrics
- Use buyer or seller contact data for any purpose other than the specific business communication for which it was provided
- Sell, transfer, rent, disclose, or enrich buyer inquiry data, seller contact data, chat data, call data, RFQ data, or directory records with third-party data brokers or lead resellers
- Publish content that infringes intellectual property rights, publicity rights, privacy rights, or contractual rights of third parties, including unauthorized trademarks, logos, product photos, brochures, catalogues, and copyrighted images
11. Automail Biz B2B Directory Terms
11.1 Nature of the Directory
Automail Biz (biz.automail.digital) is an online B2B business directory and procurement discovery platform that helps buyers discover sellers, suppliers, manufacturers, exporters, service providers, and other business users. Automail Digital operates as an intermediary within the meaning of Section 2(1)(w) of the Information Technology Act, 2000, and complies with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended).
Automail Digital does not manufacture, stock, own, inspect, sell, purchase, import, export, warehouse, ship, insure, finance, or deliver any product or service listed on Automail Biz. We do not become a party to any quotation, purchase order, invoice, payment, shipment, warranty, return, quality claim, or dispute between buyers and sellers. All listings, RFQs, inquiries, quotes, chats, calls, reviews, and related communications are created or initiated by users. Automail Digital claims the benefit of safe harbour protections under Section 79 of the Information Technology Act, 2000, for third-party content made available through the platform.
11.2 Directory Features Covered by These Terms
The Automail Biz terms apply to all current and future directory features, including business pages, public listings, product catalogues, industry and city indexes, search filters, saved searches, shortlists, buyer profiles, seller profiles, RFQs, quotes, inquiry forms, inquiry credits, live chat, buyer-seller calls, callback requests, reports, reviews, ratings, verification badges, analytics, sponsored or promoted placement tools, SEO pages, notification alerts, WhatsApp/email/in-app inquiry delivery, and any Automail email automation connected to Biz inquiries.
New features, beta features, translated interfaces, mobile/PWA experiences, and regional or enterprise workflows are also governed by these Terms unless Automail Digital publishes separate supplemental terms for a specific feature.
11.3 Account, Email Verification, and Onboarding
- Automail Biz may require email verification, password setup, phone verification, buyer onboarding, seller onboarding, or additional review before you can access certain features.
- You must provide accurate onboarding information, including your name, business role, company information, city, state, buyer interests, seller category, product information, and contact details where requested.
- You are responsible for maintaining secure access to your account and for all activity carried out through your account, team members, devices, integrations, and authorized representatives.
- Automail Digital may reject, delay, limit, or re-verify accounts where signup data, email verification, phone verification, business details, or usage behavior appears incomplete, suspicious, automated, fraudulent, or inconsistent with these Terms.
11.4 Seller and Business Page Obligations
By creating, claiming, publishing, editing, or managing a business page or seller profile on Automail Biz, you represent and warrant that:
- All business names, trade names, addresses, city/state information, contact details, product details, price ranges, MOQ values, HSN/SAC codes, certifications, registration numbers, factory details, export details, quality processes, media assets, and claims are accurate, current, lawful, and not misleading
- You hold all licenses, registrations, approvals, authorizations, permits, and third-party permissions required for the products, services, images, marks, documents, and claims you publish
- Your listing does not include prohibited, restricted, counterfeit, unsafe, infringing, sanctioned, unlicensed, deceptively described, or unlawfully advertised products or services
- You will respond to buyer inquiries, RFQs, chats, calls, callback requests, and quote requests professionally and only for legitimate business purposes
- You will not add buyers to marketing lists, automation sequences, WhatsApp campaigns, or outbound sales lists unless you have a lawful basis and required consent to do so
- You will comply with applicable Indian laws and sector-specific laws, including where relevant the Consumer Protection Act 2019, Legal Metrology Act 2009, Drugs and Cosmetics Act 1940, Food Safety and Standards Act 2006, GST laws, import-export laws, data protection laws, intellectual property laws, advertising laws, and all licensing or safety laws applicable to your business
- You are fully responsible for disputes, claims, inspections, taxes, licenses, product safety, labeling, quality, delivery, payment collection, refunds, warranties, after-sales service, and regulatory compliance arising from your products or services
11.5 Buyer, RFQ, and Procurement User Obligations
By browsing Automail Biz, creating a buyer profile, saving searches, shortlisting sellers, submitting inquiries, posting RFQs, starting chats, initiating calls, requesting callbacks, or asking sellers for quotes, you agree that:
- Your inquiries, RFQs, messages, calls, and quote requests must represent genuine business interest and must not be spam, harassment, phishing, competitive intelligence harvesting, or lead harvesting
- You are solely responsible for conducting due diligence before entering into any transaction, including checking seller identity, registration status, licenses, samples, certifications, product quality, capacity, pricing, payment terms, delivery terms, export/import requirements, and legal compliance
- Automail Digital does not guarantee seller responsiveness, product availability, pricing, MOQ, delivery timeline, certification validity, creditworthiness, quality, or post-sale performance
- Your inquiry data, RFQ details, chat messages, call requests, callback contact details, and procurement requirements may be shared with the seller or relevant participants to enable the requested business communication
- You must not use Automail Biz to pressure sellers into unlawful, misleading, unsafe, sanctioned, counterfeit, tax-evasive, or off-record transactions
11.6 Verification, Badges, and Trust Signals
Automail Biz may display trust signals such as email verification, phone verification, GSTIN, Udyam/MSME, PAN, IEC, CIN, DUNS, document upload status, response speed, review signals, listing completeness, category fit, and other platform-generated badges or scores. These signals are provided to improve marketplace transparency, but they are not legal, financial, quality, safety, export, procurement, or compliance guarantees.
- A verification badge means only that a specific data point or workflow was submitted, checked, or confirmed according to Automail's then-current process.
- Verification does not mean Automail Digital endorses the business, guarantees transaction performance, certifies the goods, or accepts liability for user conduct.
- Automail Digital may update, revoke, hide, downgrade, or require re-verification of any badge, score, ranking, or trust signal at any time if information becomes stale, incomplete, disputed, suspicious, or inconsistent with platform policy.
11.7 Listings, Prohibited Items, and Restricted Categories
You must not list, request, advertise, quote, promote, broker, or facilitate prohibited items, restricted products without required authorization, illegal services, counterfeit goods, unsafe goods, infringing goods, sanctioned trade, deceptive products, or products/services that cannot lawfully be sold, advertised, exported, imported, transported, stored, or supplied in the relevant jurisdiction. This restriction applies to business pages, product catalogues, images, brochures, tags, RFQs, search keywords, chats, calls, quotes, reviews, and any hidden or indirect description of the same item or service.
Automail Digital may require documentation, licenses, invoices, safety data sheets, test reports, registration certificates, brand authorization, export/import documents, or other evidence before allowing a listing, inquiry, quote, RFQ, or communication to remain available. Failure to provide satisfactory evidence may result in removal, suspension, delisting, account limitation, credit forfeiture where permitted by law, or reporting to appropriate authorities.
11.8 Search, Ranking, Visibility, and Sponsored Placement
Automail Biz may rank, filter, sort, promote, demote, or display listings based on factors such as search relevance, listing completeness, category match, city match, verification status, buyer intent, response speed, quality signals, user preferences, recency, fraud prevention signals, technical availability, and optional sponsored placement credits. Search results and rankings are dynamic and may change without notice.
Sponsored or promoted placements, if offered, increase visibility only as described in the platform. They do not guarantee inquiries, orders, buyer interest, revenue, search position, verification, or endorsement by Automail Digital.
11.9 Inquiries, Chat, Calls, RFQs, Quotes, and Follow-Up Automation
- Automail Biz may deliver buyer inquiries and RFQs to sellers through in-app notifications, email, WhatsApp, chat, call workflows, callback requests, and connected Automail email automation.
- Automail Digital may use anti-spam checks, MX validation, rate limits, honeypot checks, reCAPTCHA, disposable email checks, duplicate detection, content moderation, and other abuse controls before or after delivering an inquiry.
- Sellers remain responsible for ensuring that any reply, follow-up, email sequence, brochure, quotation, price list, or call complies with applicable laws and consent requirements.
- Automail Digital is not responsible for whether a buyer opens, reads, answers, accepts, rejects, negotiates, or acts on an inquiry, quote, chat, call, callback, or automated follow-up.
- RFQs and quotes are non-binding unless the buyer and seller separately enter into a binding written agreement outside Automail Biz or through a dedicated feature that expressly states it creates binding obligations.
11.10 Reviews, Reports, and Marketplace Integrity
Users may be allowed to report listings, report abuse, submit reviews, flag fraud, or provide quality signals. Reviews, reports, and signals must be truthful, based on genuine experience or good-faith concerns, and must not be used to harass competitors, manipulate ranking, extort users, or publish confidential information. Automail Digital may remove, hide, investigate, or preserve such content at its discretion and may cooperate with law enforcement, regulators, payment processors, hosting providers, or rights holders where legally required or reasonably necessary.
11.11 Content Moderation, Takedown, and Platform Controls
Automail Digital reserves the right, but does not assume an obligation, to:
- Review, edit, reject, hide, de-index, unpublish, suspend, or remove any listing, RFQ, inquiry, quote, chat, review, image, document, product, category, keyword, badge, or account that violates these Terms, platform policy, third-party rights, or applicable law
- Restrict visibility based on SEO completeness, quality standards, suspected abuse, duplicate listings, verification concerns, missing documents, buyer safety, or legal risk
- Rate limit, quarantine, delay, or block suspicious inquiries, RFQs, chats, calls, signups, search activity, reports, reviews, or automated behavior
- Preserve records where needed for security, fraud prevention, accounting, dispute management, legal compliance, audit, or enforcement purposes
- Suspend or terminate accounts for repeated violations, serious violations, non-cooperation, fraud, illegal activity, or attempts to bypass enforcement systems
11.12 Inquiry Credits and Paid Directory Features
Automail Biz may operate inquiry credits, sponsored placement credits, promotion credits, reveal credits, or similar paid or usage-based features. The following terms apply unless a feature screen states otherwise:
- Credits are purchased through the Automail platform and are non-transferable between accounts
- Credits may be consumed when specific inquiry, promotion, visibility, reveal, RFQ, analytics, automation, or directory actions are performed as described in the platform
- Credit balances are not redeemable for cash or any monetary equivalent unless required by applicable law
- Automail Digital may modify credit pricing, included limits, sponsored placement rules, or credit consumption rules with 30 days' prior notice where commercially reasonable
- Fraudulent use of the credit system, fake inquiries, artificial consumption, chargeback abuse, payment fraud, or attempts to transfer or resell credits may result in account termination and forfeiture of remaining credits where permitted by law
11.13 Listing Removal, Account Closure, and Data Retention
- Sellers may unpublish or delete their business page through available dashboard tools or by contacting support where a self-serve control is unavailable.
- Upon deletion or unpublishing, the public listing will be removed from active directory display. Cached copies, search engine snippets, shared links, analytics logs, backups, and previously sent communications may take time to expire or de-index.
- Inquiry history, RFQs, quotes, chats, calls, reports, moderation records, credit transactions, invoices, logs, and abuse-prevention data may be retained as needed for accounting, legal compliance, security, fraud prevention, dispute resolution, audit, and enforcement purposes.
11.14 No Agency, Partnership, Employment, or Procurement Endorsement
Use of Automail Biz does not create any agency, partnership, joint venture, employment, franchise, distributorship, procurement approval, dealership, fiduciary relationship, or representative relationship between Automail Digital and any buyer, seller, supplier, manufacturer, exporter, service provider, or other user. No user may represent that Automail Digital has approved, certified, sponsored, guaranteed, financed, insured, or procured a transaction unless we expressly state so in writing.
11.15 Limitation of Liability for Automail Biz
In its capacity as an intermediary and technology platform, Automail Digital shall not be held responsible for:
- The quality, safety, legality, merchantability, fitness, availability, origin, certification, price, warranty, delivery, or regulatory status of any product or service listed, requested, quoted, discussed, or purchased through Automail Biz
- The accuracy, completeness, timeliness, truthfulness, or legality of information provided by buyers, sellers, reviewers, callers, chat participants, RFQ creators, or other users
- Any dispute, loss, damage, injury, delay, fraud, non-payment, non-delivery, product defect, quality rejection, chargeback, tax issue, import/export issue, or regulatory action arising from transactions or communications between users
- Any failure of a buyer or seller to respond, negotiate, honor a quote, close a transaction, meet a delivery date, comply with a purchase order, provide after-sales support, or resolve a complaint
- Business losses resulting from listing removal, ranking changes, badge changes, account suspension, credit consumption, service interruption, moderation decisions, feature changes, or search visibility changes
Users acknowledge that Automail Digital acts solely as a technology platform facilitating discoverability, communication, and workflow automation. All risks associated with transactions concluded through contacts made via Automail Biz are borne entirely by the transacting parties.
12. Service Modifications
Automail reserves the right to modify, suspend, or discontinue any feature or aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for exercising this right. New or modified features are subject to these Terms unless Automail publishes separate supplemental terms.
13. Termination and Account Closure
We may suspend or terminate your account and access to any Automail service immediately, without prior notice or liability, for any reason, including breach of these Terms, violation of applicable law, or conduct that we determine to be harmful to the platform or other users. Upon termination:
- Your personal data and associated content will be deleted within 30 days, subject to data we are required to retain for legal, accounting, or security compliance.
- Any connected account authorisations will be revoked from our systems.
- Active paid subscriptions are not refunded for any remaining period unless required by applicable law.
- Inquiry history, RFQ records, credit transactions, invoices, and abuse-prevention data may be retained as needed for legal and regulatory purposes.
You may close your account at any time from your account settings or by contacting support@automail.digital.
14. Indemnification
You agree to indemnify, defend, and hold harmless Automail Digital, its directors, officers, employees, contractors, and agents from and against any claims, demands, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of any Automail service; (b) the content or data you submit, upload, or transmit through the platform; (c) your violation of these Terms; (d) your violation of any applicable law or the rights of any third party; or (e) any transaction or dispute between you and another user arising from use of Automail Biz.
15. Limitation Period
